Článok sa zaoberá analýzou niektorých najdôležitejších častí rozhodnutia Európskeho súdu pre ľudské práva (ďalej len "Súd") vo veci E. S. proti Rakúsku, v ktorom Súd potvrdil, že rakúske súdy právom odsúdili sťažovateľku za znevažujúce výroky voči islamskému prorokovi Mohamedovi. Článok sa zameriava predovšetkým na tie časti rozhodnutia Súdu, ktoré sa týkajú legitímnosti cieľa zásahu a nevyhnutnosti zásahu v demokratickej spoločnosti. The article deals with the analysis of some of the most important parts of the judgment of European Court for Human Rights in the case E. S. against Austria in which the Court confirmed that the Austrian courts were right when convicted the applicant for abusive statements against the Islamic Prophet Muhammad. The article focuses in particular on those parts of the Court's decision which are concerning the legitimacy of the aim of the intervention and the necessity of intervention in a democratic society.
