Anotace Tento článek si klade za cíl na základě účinné právní úpravy a aktuální judikatury zanalyzovat, jakými způsoby lze zlikvidovat spoluvlastnický vztah v českém právním řádu. Dále bude provedeno jejich srovnání a rozlišení. Následně budou identifikovány a specifikovány výjimky, které brání bezprostřední realizaci časově neomezeného práva spoluvlastníka spoluvlastnický vztah opustit. Annotation The aim of this article is to analyse, on the basis of effective legislation and current case law, the ways in which the co-ownership relationship can be liquidated in the Czech legal system. Furthermore, their comparison and distinction will be made. Subsequently, the exceptions that prevent the immediate realisation of the unlimited right of the co-owner to leave the co-ownership relationship will be identified and specified.
