Anotácia Prvá časť príspevku sa venuje zákonným znakom trestnému činu nebezpečného prenasledovania podľa ustanovenia § 360a Trestného zákona v kontexte aplikačnej praxe osobitne prenasledovaniu medzi bývalými partnermi. V kontexte judikatúry slovenských súdov je pozornosť zameraná najmä na zákonný znak dlhodobosti, pričom k potrebe jeho zakotvenia v skutkovej podstate trestného činu nebezpečného prenasledovania v druhej časti príspevku autorka zaujala svoje stanovisko vychádzajúc z pripravovanej novely Trestného zákona. Annotation The first part of the paper is devoted to the statutory features of the offence of dangerous pursuit under the provisions of Section 360a of the Criminal Code in the context of the application practice, specifically the pursuit between former partners. In the context of the case law of the Slovak courts, attention is focused in particular on the statutory feature of longevity, while the author takes a position on the necessity of enshrining it in the facts of the offence of dangerous persecution in the second part of the paper, based on the forthcoming amendment to the Criminal Code.
