V Európe už niekoľko rokov vzniká nový systém riešenia patentových sporov. Dohovor o jednotnom patentovom súde vytvára nový regionálny súdny systém s mnohými špecifikami. Tento článok analyzuje jeho ústavnosť a súladnosť s medzinárodným právom, s akcentom na otázku delegovania právomocí a aplikovateľnosť Charty EÚ a Európskeho dohovoru o ľudských právach. In Europe, a new patent litigation system has been in making for a number of years. The Agreement on a Unitary Patent Court creates a new regional judicial system with many specific features. This article analyses its constitutionality and compatibility with the international law. In particular, it highlights the issue of delegation of powers and the applicability of the EU Charter and the European Convention on Human Rights.
