What will the legislator introduce through the amendment to the Criminal Code regarding unauthorized handling of waste? The submitted scholarly text is devoted to the criminal-law aspects of the offense of unauthorized handling of waste pursuant to Section 302 of the Criminal Code, with the main objective being to assess whether the proposed legal regulation is sufficient to sanction unlawful conduct that falls within the scope of this offense in society. A partial objective will be to identify the shortcomings of the current legal framework, while the author will also seek to provide proposals de lege ferenda aimed at improving the legal regulation pro futuro. In order for the author to carry out a relevant synthesis of the findings, it will be necessary to focus attention also on criminal liability within the broader context of environmental protection in genere. In this regard, the paper will define the importance and necessity of criminal-law protection in relation to other types of legal liability. Finally, the contribution also compares administrative liability for environmental offenses, with the aim of providing a comprehensive interpretation and establishing definitional criteria distinguishing administrative liability of the offender from criminal liability for a potential criminal offense.
