Nezávislosť športového tribunálu

Analyzované rozhodnutie je krokom k zvýšeniu autonómnosti športu. V prípade, že ide o riešenie sporov v oblasti športu obligatórnou arbitrážou, potom po prvé, športový tribunál musí byť kreovaný a rozhodovať na základe požiadaviek článku 6 Dohovoru o ochrane ľudských práv a základných slobôd, a po druhé, jeho rozhodnutia sú nepreskúmateľné všeobecnými súdmi. Tieto skutočnosti sa potom premietajú do aktuálnej právnej úpravy v Slovenskej republike. The analysed decision is a step towards increasing the autonomy of sport. With respect to the disputes resolution in the field of sport by obligatory arbitration, firstly, the sports tribunal has to be created and decided on the basis of the requirements of Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms and, secondly, its decisions are not reviewable by the ordinary courts. These facts are subsequently reflected in the current legislation in the Slovak Republic.
