Osobná zodpovednosť

V subjektívne ladenej úvahe autor1) na pozadí piatich samostatných prípadov dokumentuje náležitosť samostatného prístupu a vlastného rozmýšľania osoby aplikujúcej právo. Autor argumentuje tým, že práve takýto prístup - aj za cenu vybočenia zo zabehaných koľají - je najkratšou cestou k posunu (nielen) vo vývoji práva. Ak je jeho výsledkom logické riešenie, jeho aplikácia navzdory rozpornosti s názorom väčšiny je vecou osobnej zodpovednosti a statočnosti tej-ktorej osoby aplikujúcej a vykonávajúcej právo. In this subjective reflexion, the author documents, against the background of five independent cases, the appropriateness of independent approach and "own" thinking of the individual applying the law. The author argues that this approach, despite its deviation from what is customary, indeed presents the fastest route to progress in (but not limited to) legal development. If the utilisation of this approach results in a logical solution, its application in spite of inconsistence with majority opinion is a question of personal responsibility and bravery of the individual who is applying and executing the law.
