Preverovanie investícií

Článok v prvej časti vysvetľuje historický vývoj preverovania investícií a motívy, ktoré viedli k vytvoreniu mechanizmu preverovania investícií.V druhej časti analyzuje špecifické charakteristiky Nariadenia 2019/452 a najmä jeho komplikované aplikovanie v praxi. V poslednej časti článok kriticky analyzuje novelu zákona č. 45/2011, ktorou sa do slovenského právneho poriadku narýchlo a bez širšej diskusie vložili určité prvky preverovania investícií. The article in the first part explains the historical development of investment screening and the motives that led to the creation of the investment screening mechanism. In the second part article analyses distinct aspects of Regulation 2019/452, especially its complicated application in practice. In the last part, the article critically analysed the amendment to Act No. 45/2011, which quickly and without a wider discussion implemented certain elements of investment screening into the Slovak legal system.
