Rozdeľovanie obce

Autor v predkladanom článku analyzuje modifikácie územného základu obce, spočívajúce v zlúčení obcí a rozdelení obce. Zaoberá sa právno-teoreticky a právno-aplikačne problémovými aspektmi platnej právnej úpravy rozdelenia obce a zlučovania obcí. Oba inštitúty porovnáva s obdobnými úpravami v súkromnom práve a zahraničnými obecnými zriadeniami. Analyzuje a hodnotí odraz normatívnej regulácie integračných a dezintegračných zmien územia obce v praxi orgánov aplikácie práva a formuluje návrhy na zmenu legislatívy de lege ferenda. In the presented article, the author analyses the modifications of the territorial base of the municipality consisting in the merger of municipalities and the division of the municipality. Author also deals with legal theoretical and legal applica tion problematic aspects of the valid legal regula tion of the division of a municipality and the amalgamation of municipalities. He compares both institutes with similar regulations in private law and foreign municipal establishments. He analyses and evaluates the reflection of the normative regulation of integration and disintegration changes in the territory of the municipality in the practice of law enforcement authorities and formulates proposals (options) ofchanging the legislation de lege ferenda.
