Anotácia Príspevok pojednáva o problematike informovaného súhlasu, o vybraných aspektoch jeho formy a obsahu, ako aj hraniciach jeho aplikácie na pozadí doktríny, medicínskej praxe, rozhodnutí ESĽP, ako aj vnútroštátnych súdov. Annotation This contribution deals with the issues of informed consent, selected aspects of its form and content, and limits of its application within the proces of healtcare. It also concerns some of the decision-making activities of the courts, the Strasbourg case law, as well as national decisional interpretation.

Anotácia Současné zdravotnické právo i lékařská etika jsou ovládány paradigmatem autonomie vůle pacienta. Nezbytnou podmínkou pro naplnění této autonomie je dostatečná informovanost pacienta o jeho zdravotním stavu a plánovaných zdravotnických výkonech. Článek analyzuje a hodnotí českou právní úpravu svobodného a informovaného souhlasu z hlediska vyrovnání informačního deficitu ve vztahu lékař-pacient, zejména rozsahem a formou poučení. Annotation Contemporary health law and medical ethics are permeated by the paradigm of the autonomy of will of the patient. The provision of sufficient information regarding the patient's health conditions and planned interventions is a necessary condition for the autonomy of will to be realised. The article analyses and assesses the Czech legal regulation of free and informed consent from the perspective of equalization of information asymmetry in the physician-patient relationship. Special attention is paid to the scope and form of the provision of information.
