Anotácia
Predložený príspevok má snahu analyzovať kvalitu a účinnosť ústavnoprávnych východísk výstavby a činnosti verejnej správy na Slovensku z hľadiska presadzovania práv zaručených Listinou základných práv a slobôd a Ústavou SR v kontexte procedurálnych princípov odporúčaných Výborom ministrov Rady Európy. Ťažisko vedeckého bádania spočíva vo výskume právnych aspektov viazanosti verejnej správy základnými právami, slobodami a princípmi uplatňovanými pri ich obmedzení. Existencia zákonnej úpravy procedurálneho postupu je zárukou, že adresát rozhodnutia alebo úkonu vykonávateľa verejnej správy môže aktívnym spôsobom, prostredníctvom svojich práv, ovplyvniť konečný výsledok tohto postupu. Práve z tohto dôvodu je základné právo na spravodlivý proces vo verejnej správe kľúčové. Analyzuje stav dodržiavania základných práv a slobôd pri výkone činnosti verejnej správy, hodnotí mieru účinnosti právnych prostriedkov, prostredníctvom ktorých sa môže adresát brániť pred porušením svojho subjektívneho práva. Súčasne poukazuje na legislatívne úskalia a navrhuje možné aj keď nie jediné úvahy de lege ferenda.
Annotation
This paper aims to analyze the quality and effectiveness of constitutional grounds for the formation and activities of public administration in Slovakia in terms of enforcing the rights guaranteed by the Charter of Fundamental Rights and Freedoms and the Constitution of the Slovak Republic. All the above, in the context of procedural principles recommended by the Committee of Ministers of the Council of Europe. The scientific interest lies in the desire to research legal aspects of the public administration's commitment to the fundamental rights, freedoms and the principles applied in their limitation. The existence of a statutory procedure is a guarantee that the addressee of a decision or act by a public administration officer can actively influence, through its rights, the final outcome of that procedure. It is for this reason that the fundamental right to a fair trial in public administration is crucial. It analyzes the commitment to fundamental rights and freedoms in the execution of public administration activities, assesses the effectiveness of legal means by which the addressee can defend himself against violation of his or her subjective right. At the same time, it points to legislative pitfalls and suggests not just thoughts but serious considerations for lex ferenda.

Príspevok vychádza v podstatnej časti z habilitačnej prednášky autorky, ktorá odznela dňa 27.2.2020 na Fakulte práva Paneurópskej vysokej školy. Téma bola zvolená ako prierezová z pohľadu použitia komparácie inštitútu náhradného materstva, čo je didaktikou výučby Svetových právnych systémov, z pohľadu tzv. poradného stanoviska rieši sui generis cezhraničný konflikt, ktorý je vlastný skúmaniu medzinárodného práva súkromného, ale je predovšetkým významným aplikačným problémom, ktorý je podstatou výučby klinickými formami (tzv. kliniky práva). Tým autorka pokryla najdôležitejšie akademické a pedagogické oblasti svojho pôsobenia. Príspevok má načrtnúť problematiku v jej podstate, historickom kontexte, ako aj prostredníctvom poradného stanoviska ESĽP v možných perspektívach vývoja náhradného materstva.
The paper is largely based on the author's habilitation lecture, which was given on February 27, 2020 at the Faculty of Law of the Pan-European University. The topic was chosen as a cross-section from the point of view of the use of the comparison of the institute of surrogate motherhood, which is the didactics of teaching the World legal systems. The Advisory Opinion addresses a cross-border conflict sui generis, which is intrinsic to the Private International Law, but is as well an important application problem, which is emphasized in teaching so-called Legal clinics. The author thus covered the most important academic and teaching areas of her work. The paper is intended to outline the issue in its essence, historical context, as well as through the ECHR's Advisory Opinion the possible perspectives for the development of surrogacy.
