Právo duševného vlastníctva

Tento článok skúma, ako súdy interpretujú geografické označovanie, aký vplyv mali podobné prípady - napríklad švajčiarska čokoláda, Parmigiano Reggiano či Champagne - na medzinárodné potravinové právo a čo to znamená pre podniky a spotrebiteľov v budúcnosti.

Autor v článku analyzuje problematiku identifikácie osoby držiteľa tovaru alebo deklaranta, čiže subjektu, s ktorým colné orgány po zaistení tovaru alebo po pozastavení jeho prepustenia komunikujú v súlade s predpismi upravujúcimi presadzovanie práv duševného vlastníctva a ktorý je, okrem iného, oprávnený vysloviť súhlas so zničením tovaru. In the article, the author analyses issue of determination of the holder of the goods or the declarant, i. e., the subject who customs authorities after the detention of the goods or suspension of the release communicate with in accordance with intellectual property rights enforcement legislation, and who is, among other things, empowered to express his or her consent with the destruction of the goods.
