The paper comments on a ruling given by Supreme Administrative Court of the Slovak Republic in case no. 33D 17/2021 dated 17 October 2022, which has been separately published in the collection of said court under no. 47/2023. The ruling concerns the question of disciplinary liability of a judge of the Supreme Court of the Slovak Republic who, as a member of a tribunal, did not submit to an opinion that had a binding effect of cassation and that was presented in the finding of the Constitutional Court of the Slovak Republic. Its author disagrees with certain conclusions drawn in the commented ruling. This review follows up on an earlier paper on binding effect of cassation exhibited by judicial rulings, published in this issue of journal Justičná revue.
